Powersports Aftermarket Products
>> Rider shall participate as an amateur/professional in one or more motor sports competitions which Sponsor is involved in.
>>Rider shall use Sponsor’s Products on their racing equipment, including race vehicle(s), and promote the Products at all competitions and during practice/testing sessions.
>>Rider shall NOT use or promote any Products that are in direct competition of Sponsor’s Products.
>>Rider shall promote Sponsor with Sponsor’s logos in clear sight mounted on their racing equipment, including race vehicle(s), transport trailer(s), transport vehicle(s) and pit vehicle(s).
>>Rider shall promote Sponsor on Social Media and online forums by actively being involved and suggesting Sponsor’s Products whenever possible.
>>Rider shall list Sponsor as one of Rider’s sponsor’s at all competitive events, on entry forms and on all of Rider’s promotional materials. Rider shall mention Sponsor on the podium of competitive events.
>>Rider agrees to have a positive attitude and sportsmanship when promoting Sponsor. This includes whenever the Sponsor logo and/or Products are visible to others and includes all parties within the Rider’s team. Sponsor will not tolerate poor attitudes of their Riders or team members which could negatively reflect back on Sponsor’s decision to support a given Rider.
>> Supplied JCRACING promotional material must be on hand for potential inquiring customers at each attended events. Promotional material will be sent to rider at the time of Rider’s first order.
>> Upon request by Sponsor, Rider shall cooperate and assist Sponsor in the development of advertisements featuring Rider.
>> Upon request by Sponsor, Rider shall cooperate and assist Sponsor in the development of product, to include product testing and Rider feedback.
>> Rider shall be solely responsible for all costs and risks associated with Rider’s racing activities.
>>Subject to the terms of this agreement, JCRACING will provide Rider with Products, offered at a discount.
>>JCRACING apparel and promotional material will be sent to Rider at the time of Rider’s first order.
>>Sponsor shall have the right to terminate this Agreement if any of the Rider’s Duties and Obligations listed above are not met.
>>Either party may terminate this agreement for any reason by giving a 7 day notice via writing or via email.
Rider acknowledges that there are known and unknown risks associated with Rider participation in motor sports practice, testing and racing. Rider hereby assumes full responsibility and releases liability of Sponsor and Sponsor’s affiliates for any and all reasons.
Rider agrees to hold harmless Sponsor and Sponsor’s affiliates.
This contract shall be construed under California law, any disagreement shall be settled in the Court of San Diego County.
If any provision within this contract is rendered void in court, this does not mean the rest of this contract is void.
full. I/we understand, that I/we will be expected to meet the terms and conditions set forth within this binding contract, and that by signing; I/we accept the responsibility of all that is required to fulfill this contract.
